1. Acceptance of Terms & Operator Information

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and MyChingu ("we", "us", or "our"), operated from France. By downloading, accessing, or using the MyChingu mobile application, web companion, software, or associated services (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

2. Eligibility & Account Security

You must be at least 13 years of age (or the minimum legal age of digital consent required in your country, such as 16 in certain European member states) to use MyChingu. By using the Service, you represent and warrant that you possess the legal capacity to enter into this agreement.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at contact@mychingu.com if you suspect any unauthorized access or security breach.

3. Chingu AI Companion & Generative Content Disclaimer

Chingu AI is an automated generative conversational assistant. You expressly acknowledge and agree to the following:

• Chingu AI responses are generated automatically through computational language models and are intended solely for entertainment, cultural appreciation, and creative journaling reflection.
• Generative AI models may occasionally generate inaccurate, incomplete, misleading, or unexpected output ("hallucinations"). You should never rely on Chingu AI for financial, legal, medical, or life-critical decisions.
• To the fullest extent permitted by applicable law, MyChingu disclaims any liability for damages, misunderstandings, emotional distress, or decisions arising directly or indirectly from conversations with or output generated by Chingu AI.

4. Dynamic Quotas, Feature Limits & Resource Allocation

To maintain service quality, protect infrastructure integrity, prevent automated scraping or abuse, and manage operational costs, we reserve the right to:

• Establish and dynamically modify daily, weekly, or monthly usage limits (quotas) on AI conversational turns, cloud storage, and premium features for both free and paid tiers.
• Implement rate-limiting, temporary cooldown periods, or bandwidth throttling in the event of abnormal server load or suspected automated bot activities.
• Adjust or introduce new tier structures, feature allocations, and system capabilities with reasonable advance notice where applicable.

5. K-Pop & Cultural Information Non-Affiliation Disclaimer

MyChingu is an independent lifestyle and cultural appreciation application. Any references to K-Pop idols, Korean celebrities, music groups, entertainment companies, drama titles, or public figures are strictly for informational, educational, and fan calendar tracking purposes. MyChingu is not affiliated with, sponsored by, endorsed by, or officially associated with any Korean entertainment agency (including HYBE, SM Entertainment, JYP Entertainment, YG Entertainment, or others), music label, or artist. All registered trademarks and artist names remain the property of their respective owners.

6. Subscriptions, In-App Purchases, Billing & Free Trials

MyChingu provides both a free tier and optional auto-renewing premium subscription packages (such as Weekly, Monthly, and Annual plans):

• 7-Day Free Trial (Annual Plan): Where offered, the 7-day free trial is available exclusively to eligible new subscribers. Unless canceled at least 24 hours before the end of the 7-day trial period, the subscription will automatically convert into a paid annual recurring subscription, and your payment method will be charged through your app store account.
• In-App Billing & Auto-Renewal: All payments, subscriptions, and recurring renewals are processed directly through the official app store platform (Google Play Store or Apple App Store). Subscriptions automatically renew at the end of each billing cycle unless turned off in your app store account settings at least 24 hours prior to renewal.
• Cancellations & Refunds: Canceling a subscription halts future recurring billings; you retain access to premium features until the end of your currently paid billing period. Refund requests are subject to the official refund policies and terms of the Google Play Store or Apple App Store through which the purchase was made.
• EU Right of Withdrawal: In accordance with Article L221-28 of the French Consumer Code (*Code de la consommation*) and EU consumer law, you expressly acknowledge that digital content and services begin immediately upon purchase or trial activation, and you waive your statutory 14-day right of withdrawal once digital supply has commenced.

7. Device Notifications, Alarms & Offline Storage Disclaimer

The delivery and timeliness of push notifications, reminder alarms, and idol birthday alerts depend entirely on your device hardware, network connectivity, and operating system battery optimization policies (such as Android Doze mode or iOS background refresh restrictions). MyChingu bears no responsibility or liability for missed reminders or scheduled alarms.

If you utilize MyChingu in Guest Mode without logging into a cloud-backed account, your journal entries and settings are stored locally on your device. We are not liable for data loss resulting from device damage, OS updates, factory resets, or app uninstallation without an active cloud sync backup.

8. Intellectual Property Rights

All original mascot illustrations, character artworks, logos, branding, user interface designs, visual aesthetics, sound assets, and software code constituting MyChingu are the exclusive intellectual property of MyChingu and its licensors. You may not copy, reverse-engineer, decompile, distribute, republish, or create derivative works from any part of the Service without our express prior written permission.

9. User Generated Content & Ownership

You retain 100% ownership and copyright over the personal diary reflections, journal entries, and personal photographs you create or upload in MyChingu. By using cloud synchronization, you grant MyChingu a strictly limited, non-exclusive, worldwide license to host, store, back up, and transmit your content solely for the purpose of operating and displaying the Service to you.

10. Acceptable Use & Security Rules

You agree not to misuse the Service. Specifically, you agree not to:

• Engage in illegal, defamatory, abusive, fraudulent, or harmful conduct.
• Attempt to probe, scan, reverse engineer, jailbreak, or compromise the security of our application, API endpoints, or AI companions.
• Perform prompt injection attacks, automated scraping, or data extraction on our AI conversational infrastructure.
• Interfere with or disrupt the servers, networks, or connected database services.

We reserve the right to immediately suspend or permanently terminate access for any account found in violation of these security provisions.

11. Disclaimer of Warranties ("AS IS")

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR FREE FROM BUGS OR OUTAGES.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYCHINGU, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, EMOTIONAL DISTRESS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, CHINGU AI OUTPUTS, OR THIRD-PARTY ADVERTISEMENTS.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING UNDER OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE STRICTLY LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO MYCHINGU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR FIFTY EUROS (€50.00), WHICHEVER IS LESS.

13. Indemnification

You agree to defend, indemnify, and hold harmless MyChingu, its operators, officers, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from or relating to your violation of these Terms, your misuse of the Service or Chingu AI, or any content you submit.

14. Governing Law, Dispute Resolution & Consumer Mediation

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.

For European consumers: In accordance with Article L612-1 of the French Consumer Code, in the event of an unresolved dispute, you have the right to resort free of charge to a consumer mediation service (*Médiateur de la consommation*) or access the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Any disputes that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of France, subject to any mandatory local consumer protection rules.

15. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and will not affect the validity and enforceability of any remaining provisions. These Terms and our Privacy Policy constitute the entire agreement between you and MyChingu concerning your use of the Service.
